Eric represents corporate clients and individuals in private civil and class action litigation, as well as in federal and state enforcement agency investigations and litigation.

Eric has an active complex civil litigation practice representing a diverse group of clients in high-stakes cases—certified plaintiff classes, defendants in class actions, coal companies, injured coal miners, victims of violence by state and federal law enforcement officers, and individuals subject to civil enforcement actions by regulatory agencies. While focusing his practice on class actions and commercial disputes, Eric has had the privilege of representing several individuals in serious injury and death cases. Having tried cases in state and federal court, Eric has also argued before the U.S. Court of Appeals for the Fourth Circuit. He has written and spoken on class actions and consumer finance issues and has served as an arbitrator in a commercial dispute.

  • Hardwick v. Rent-A-Center, Inc., Civil Action No 3:06-0901 (S.D. W. Va.)—consumer class action brought under W. Va. Consumer Goods Rental Protection Act; pending final approval of settlement paying $3.5 million cash, plus injunctive relief and price reductions
  • Cummins v. H&R Block, (W.Va. 2006)—$62.5 million class action settlement of consumer protection claims for class members in 26 states
  • Mountaineer Hyundai v. White Oak Land Company, (W.Va. 2007)—nuisance case on behalf of a West Virginia business which resulted in a confidential settlement
